Accounts

Account Registration

To use our services, users must create an account by providing accurate, complete, and current information as prompted during the registration process. By registering, users agree to be responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.

Registration is open to individuals who are at least 18 years of age or the age of majority in their jurisdiction, whichever is higher. By creating an account, users confirm that they meet these age requirements and that they have the legal capacity to enter into binding contracts.

Our platform offers two primary types of accounts:

  1. Student Account: For users seeking assistance with academic assignments.
  2. Scholar Account: For users qualified and willing to provide academic assistance.

Users must choose the appropriate account type based on their intended use of the platform and may be required to provide additional documentation or information to verify their eligibility for the selected account type.

Users are required to maintain an accurate and up-to-date profile, including relevant personal and professional information. Scholar accounts, in particular, must include details on academic qualifications and areas of expertise. Users consent to the platform’s use of their profile information for operational purposes, including matchmaking and quality assurance.

Users are granted a non-transferable, revocable license to access and use the platform according to these Terms of Service. Any unauthorized use of the account for commercial purposes, sharing with third parties, or other violations of these terms may result in account suspension or termination.

To maintain a trustworthy community, we may require identity verification for both students and scholars. This process helps ensure the integrity and safety of our platform. Users agree to submit to such verification processes and provide necessary documentation upon request.

Users are responsible for safeguarding their usernames and passwords and must take reasonable steps to prevent unauthorized account access. In the event of any suspected breach of security or unauthorized use of an account, users must immediately notify the platform. Users are solely responsible for the security of their login credentials and will be held liable for any activities conducted under their account, unless reported timely.

Payments

Payment Process
  • Pricing and Bidding: Students post assignments with a suggested price, and scholars can bid on these assignments. The final agreed-upon price will be secured in an escrow account upon assignment acceptance.
  • Escrow System: Funds will be held in escrow to ensure secure and fair transactions. Payment is released to the scholar only after the student approves the completed work.
  • Milestone Payments: For larger or longer-term projects, payments can be divided into milestones. Each milestone payment is released upon completion and approval of each phase of the assignment.
  • Dispute Process: In case of disputes regarding assignment quality or completion, a formal resolution process will be initiated. Both parties are encouraged to provide necessary evidence and reasoning for their case.
  • Refund Policy: If the work is deemed unsatisfactory and the scholar is at fault, the student can choose to receive a full refund to their original payment method or website credit for future use on the platform.
  • Scholar Compensation: Scholars may receive partial compensation for their efforts if the dispute resolution process finds that the student’s rejection is unreasonable or unjustified, depending on the amount of work satisfactorily completed.
  • Assignment Cancellation: If a student cancels an assignment before work begins, a full refund will be issued. If cancellation occurs after the scholar has started work, the refund amount may be adjusted based on the work completed.
  • Scholar Withdrawal: If a scholar withdraws from an assignment after agreeing to it, the student will receive a full refund, and the incident will be reviewed for potential impact on the scholar’s standing on ScholarShift.
  • Scholar Late Submission: If a scholar fails to submit work within the agreed timeframe, students may be entitled to a discount or full refund, depending on the circumstances.
  • Non-Payment by Student: Failure to release due payment after work approval without valid reason may result in account suspension or termination.
  • Secure Transactions: All transactions are processed through secure payment gateways to ensure the safety and privacy of financial information.
  • Data Protection: Financial data will be protected in accordance with our Privacy Policy and will not be shared with third parties without user consent.
  • Service Fees: The platform may charge service fees or transaction fees as applicable, which will be clearly communicated to both students and scholars.
  • Currency Conversion: For international transactions, currency conversion fees may apply as per the prevailing rates of the payment gateway.

Changes to Terms: The platform reserves the right to modify payment terms. Any changes will be communicated to users and will take effect for transactions following the announcement of changes.

General Provisions

Limitation of Liability

ScholarShift shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed its essential purpose.

You expressly understand and agree that your use of the services is at your sole risk. The services are provided on an “AS IS” and “AS AVAILABLE” basis. ScholarShift and its affiliates, expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You agree to defend, indemnify, and hold harmless ScholarShift, its affiliates, from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising or resulting from your breach of these Terms of Service, any content you post or share on or through the services, or your access to or use of the services.

These Terms of Service shall be governed by and construed in accordance with the laws of the United States of America, without giving effect to any principles of conflicts of law.

These Terms of Service constitute the entire agreement between you and ScholarShift regarding our services, superseding any prior agreements between you and ScholarShift regarding the services.

If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms of Service remain in full force and effect.

The failure of ScholarShift to enforce any right or provision of these Terms of Service will not be deemed a waiver of such right or provision.

ScholarShift reserves the right, at its sole discretion, to modify or replace these Terms of Service at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
